Ownership of Intellectual Property

All intellectual property rights of the palmarabiana, including but not limited to copyright, logos, names, trademarks, service marks, design, text, sound recordings, images, links, concepts and themes are exclusively owned by the palmarabiana. Any reproduction, transmission, publication, performance, broadcast, alteration, license, hyperlink, creation of derivative works or other use in whole or in part in any manner is strictly prohibited.

Personal Information adnd Privacy
  • User understands and acknowledges that by choosing palmarabiana you have allowed palmarabiana to use your personal information.
  • User understands, acknowledges and agrees that although palmarabiana provides appropriate firewalls and protections, the palmarabiana Service is not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible.
  • In case palmarabiana is required to disclose your personal information in order to assist the Government Authority or in adherence to the Court Order or to protect the interest of the palmarabiana Service and/or any particular user(s), palmarabiana will disclose it without obtaining prior permission from you. You authorize us to disclose your personal information.
Palmarabiana Service Use

User is hereby allowed to use the palmarabiana Service subject to acceptance of the terms and conditions and the Privacy Policy on the palmarabiana Website (“Terms”). palmarabiana retains the right to change the Terms from time to time and such modified Terms shall be immediately applicable. Our Pricing and GST impact

So why did we move to an all-inclusive pricing and why does the base price seems higher? Here is why. GST has been slashed from 18% to 5%, however none of the Input Tax Credits are available to us any longer, thereby increasing our effective input costs. Given the increased costs, benefit of tax reduction is being offset at this time. We are working overtime to reduce the input tax impact, so that we can eventually pass on the benefit to you.

Ordering

You agree that, any contract for the Food through use of Website is between you and the palmarabiana Restaurant; any contract for the supply of palmarabiana Service from the palmarabiana Website is between you and palmarabiana. You agree to take reasonable care when providing palmarabiana with your details and warrant that these details are accurate and complete at the time of ordering food. You also warrant that the credit or debit card details that you provide are of your own credit or debit card.

Agreement for Use

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to use this Site in accordance with all terms herein. You agree to be financially responsible for all of your use of this Site (as well as for use of your account by others, including without limitation minors living with you). You agree to supervise all usage by minors of this Site under your name or account. You also warrant that all information supplied by you or members of your household in using this Site is true and accurate and without limitation. You agree that if ordering facilities are made available for your use through the Site, the ordering facilities shall be used only to make legitimate purchases for you or for other people for whom you are legally authorized to act. You understand that overuse or abuse of the ordering facilities of this Site may result in your being denied access to such facilities.

Copyright Complaints

If you believe that your work has been copied and posted to our Site in a way that constitutes copyright infringement, you should provide our Copyright Agent with a written notice that sets forth the infringement details. To be effective, the notice must contain the following information: (1) a description of the copyrighted work that you believe has been infringed; (2) a description of the material that you claim is infringing the copyrighted work and a detailed description of where it is located on our Site; (3) your address, telephone number, and e-mail address; (4) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (5) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and (6) an electronic or physical signature of the copyright owner or person authorized to act on behalf of the owner of the copyright interest.We reserve the right, in appropriate circumstances and at our discretion, to terminate the privileges of any account holder who repeatedly infringes the copyrights or other intellectual property rights of palmarabiana or others.

Rules and Regulations for the use of Noor Banquet Hall

For the smooth functioning of the event the guest and the management must work in tandem in order to make it a success. The management assures of utmost cooperation in every manner possible to ensure that there are no obstacles or inconveniences in the way of conducting a smooth function.

Possession and Return
Under normal conditions, the hall would be handed over to you at 7 pm prior to the day of the event and the same would have to be vacated by 9 pm on the day of the event. For booking the hall outside of these timings please let us know and we would be happy to find a way to accommodate your request.

Booking and Payment
Full payment needs to be made for confirmation of the hall. If you have not made the full payment, then it will be considered as a tentative booking and it will be open for another party to make full payment and book the venue.

Cancellation and Change of Date
Cancellation or change of date would not be allowed for a confirmed booking. However, if after the cancellation another booking is received for the same date and time, then 75% of the amount would be refunded. If no booking is received on that date after cancellation, then the entire amount would be forfeited.
Once, the booking has been cancelled by you, the venue is free to be used for another booking on the same date and time.

General
Services of the Noor banquet hall staff or palm Arabiana staff may not be used for loading and unloading of your stuff.
You are not allowed to remove any fixtures or structures within the premises of Palm Arabiana and Noor Banquet hall. Any tampering or damage to the property, electrical appliances, fixtures and fittings of Palm Arabiana would incur an additional charge on your bill, at the sole discretion of the management. No musical instruments or loud speakers will be allowed after 10.30 p.m. or any other such time as applicable by law.
Every marriage arranged in the hall must be duly registered as per the rules laid down by law. This is the responsibility of the persons booking the hall and a copy of the marriage license must be given to the manager prior to the date of the function.
No outside food or drinks would be allowed inside our premises. We follow a no-alcohol policy and if anyone found doing so would be dealt with strongly.
Cash payment must be settled with the manager on duty and the bill should be received for the same. The manager must be consulted in advance for any lighting decorations required on the outside walls of the hall.

Safety and Security
While we exercise great care in making the halls safe, it is impossible for hall staff to be aware of who is a genuine guest at a function and who isn’t. All your belongings, valuables and cash should be looked after by you and the management takes no responsibility for their safe-keeping.

Dispute Resolution
We will always try and settle all disputes amicably and fairly. In the unlikely event that we are unable to do so, all dispute resolutions will fall under the jurisdiction of the Hyderabad Court.

PALM ARENA
  • You have made a booking for the ground and Palm Arabiana is not liable to arrange for any sports equipment, gadgets, jerseys or any other tools.
  • No food is permitted on the turf, including gum, sunflower seeds and nuts.
  • Refreshments would be charged at an additional rate and would not be served at the venue.
  • No food, drinks, smoking, chewing tobacco, chewing gum or studs permitted on playing surface. Only water in non-breakable containers is permitted on the turf.
  • The facility is available on rent to approved users for permitted uses.
  • Facility users must not enter Palm Arena prior to their permitted time and should leave the field five minutes before their scheduled time to allow transition between groups. The user must adhere to the time discipline
  • Users are prohibited from bringing animals on the turf.
  • Footwear on artificial turf fields must be molded rubber cleats, turf shoes or running shoes. Metal cleats and screw-in plastic cleats are forbidden.
  • Individuals utilizing this facility do so at their own risk and responsibility. The property owners, and staff of Palm Arabiana assume no liability for any injuries, accidents, harm or damages whatsoever which may occur during, in the past or before.
  • Conduct of users within the facility should be in the spirit of good sporting behavior and must be peaceful.
  • No alcohol or drug use prior to or during play. Doing so will result in ejection from the facility and subjection to ban.
  • If you find or lose any item, users must report it immediately to the Staff. Palm Arabiana does not assume responsibility for any lost items.
  • No glass containers on the field.
  • Palm Arabiana reserves the right to refuse play and or service to anyone.
  • Acts of God, civil unrest, natural calamity or other circumstances beyond the control of Palm Arabiana both foreseeable and unforeseeable may prevent completion of a game or session. In the event of incomplete session and if completion of a game or session cannot be concluded in a reasonable period of time, Palm Arabiana management reserves the right to fix the pro-rated returns.
  • Users booking for themselves or on behalf of their group members (friends, teams members, opposite team members cannot claim any relief against any damages, injury, harms whatsoever from Palm Arabiana.
  • Users must adhere to hygienic conditions specified by Palm Arabiana.
  • Any willful damage caused by the users, he/she shall indemnify Palm Arabiana for the loss or damage caused by the user.
  • Fee for the booking is non-refundable if cancelled between 0 – 3 days of the date of booking. If cancelled 3 or more days before the date of booking, then 5% of the booking amount would be refundable excluding the taxes.
  • It takes 7-10 working days for the refund to appear on the account from where the payment was made.
Code of conduct for Drivers
  • Strict adherence to the rules and respecting the racing officials’ decision / instruction is mandatory.
  • All participants must respect the rights, dignity and value of their fellow participants regardless of gender, ability, physical appearance, cultural background or religion.
  • All participants must encourage and take responsibility for their actions at all times.
  • All participants must ensure their equipment is safe and race worthy, prior to taking part in training, testing or race events. Only approved race wear (e.g.: helmet, gloves, race boots and suit) to be used by the driver, according to the regulations.
  • It is the participants own responsibility to identify and measure his/her own skill level against his/her competitors, and take responsibility for the risks associated with training, testing and or racing. It should be noted that a basic level of competence is required.
  • It is the participant's responsibility to declare, prior to any participation in training, testing or racing, of any medical condition or medication required that may be relevant in the event of an emergency.
  • All participants are required to display courtesy and etiquette to other members and participants in training, testing and race events. Any disputes or problems that may arise during an event must be addressed in a respectful manner, to the correct person (official) at the event.
  • The safety of children within the sport is a priority. Knowledge of the code of ethics surrounding care of children in sports will be promoted and encouraged. It is the participant's own responsibility to ensure the safety of their children at training, testing or racing events.
  • When taking part in any event, it is the responsibility of the driver to take the time to read and fully understand the posted rules, regulations and conditions for said event prior to start time, thus eliminating unnecessary delays at the beginning of the event. Requests for clarification of these rules, regulations or conditions, should be asked in the drivers meeting held before each event.
  • All participants must have respect for the environment and the surrounding inhabitants. Responsibility must be taken to reduce excessive noise and keep all areas that are used as clean and pollution free as possible.
  • All participants must respect that consumption of drugs and alcohol are strictly prohibited at or prior to the training, testing and races. It is an offence and will not be tolerated. Offenders will be excluded from the event and face further disciplinary action.
